Terms of Service

1. Agreement

These Terms of Service ("Terms") govern access to and use of the Ammasa website and the Ammasa property-data API (together, the "Service"), operated by Ammasa ("we", "us"). By accessing the Service, requesting an API key, or executing an order form that references these Terms, you agree to be bound by them. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. The Service

Ammasa aggregates publicly available and licensed property-level information from federal, state, county, municipal and commercial sources and returns it through an API, with per-field source attribution ("provenance"), confidence, coverage and freshness metadata. The Service is infrastructure for businesses; it is not directed to consumers.

3. Important restrictions — FCRA

Ammasa is not a consumer reporting agencyas defined by the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq. ("FCRA"), and the Service does not constitute a "consumer report". You must not use the Service, in whole or in part, as a factor in establishing any person's eligibility for credit, insurance, employment, housing, government benefits, or for any other purpose regulated by the FCRA. Any such use is a material breach of these Terms and grounds for immediate termination.

4. Fair Housing

Data returned by the Service describes places and properties, not people. If you present school, crime, neighborhood or similar locality signals to end users in a real-estate context, you are responsible for doing so in a manner consistent with the Fair Housing Act and applicable state law, including avoiding any use that constitutes steering or discrimination against protected classes.

5. No professional advice

Value estimates are outputs of automated valuation models and are not appraisals; they are not prepared by a licensed appraiser and must not be used where an appraisal is required. Flood data is informational and is not an official flood zone determination for lending or insurance purposes. Nothing in the Service constitutes legal, financial, insurance, engineering or investment advice.

6. API keys and acceptable use

API keys are issued per customer, are confidential, and may not be shared or embedded in client-side code. You must not exceed your plan's rate and volume limits, circumvent metering, resell raw access to the API, or use the Service to build a directly competing data-aggregation product. We may throttle, suspend, or revoke keys that violate these Terms or that create unusual load.

7. Data licensing and redistribution

Underlying sources carry differing redistribution rights. Your right to display or redistribute any field is limited to the resale scope attached to your key and confirmed in your order form. Fields from sources that do not permit redistribution are redacted for resale-scoped keys. You are responsible for preserving source attribution ("dataSource") where your agreement or the underlying source's license requires it.

8. Fees

Paid plans are billed as described in your order form. Rates shown on the website are indicative planning estimates and do not constitute a binding offer; final pricing is set in the order form. Usage is metered per request and per key.

9. Disclaimer of warranties

THE SERVICE AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE". WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. DATA ORIGINATES FROM THIRD-PARTY AND GOVERNMENT SOURCES THAT MAY CONTAIN ERRORS, GAPS OR DELAYS; COVERAGE VARIES BY JURISDICTION AND IS REPORTED PER FIELD.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE OR DATA. OUR AGGREGATE LIABILITY ARISING OUT OF THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnity

You will defend and indemnify us against claims arising from your use of the Service in violation of these Terms, including any use of data for FCRA-regulated purposes or in violation of fair-housing laws.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach, unlawful use, or risk to the Service. Sections 3–5 and 9–13 survive termination.

13. General

These Terms are governed by the laws of the State of Texas, excluding its conflict-of-law rules, and disputes will be resolved in the state or federal courts located in Travis County, Texas. We may update these Terms by posting a revised version with a new "Last updated" date; continued use after the effective date constitutes acceptance. Questions: legal@ammasa.com.
